GOODWILL VOUCHER TERMS OF SALE


This page sets out the terms of use of the www.goodwillvouchers.org and the Goodwill Vouchers App (together the “Goodwill Service”).

TERMS OF SALE

1. This agreement between you, the Customer and GoodwillVouchers Ltd [“Goodwill”], company number 8747307 sets out the terms and conditions which govern use of www.goodwillvouchers.org and the Goodwill Vouchers App (“Services”). By completing your registration, you become a “Member” and agree to these terms and conditions.

2. Subject to these Terms we act as an intermediary between you and other, third party companies (the “Businesses”) to make available access to vouchers for goods and/or services. We are never responsible for the supply by Businesses of those products/services.

USE OF SERVICES

3. Minimum Age: To register as a Member you are representing that you are over 18 years of age.

4. Place of Use: Services are directed solely at people in the UK.

5. Scope of Use: Services are for your non-commercial, personal use only. You undertake to keep user name and password secure and not to disclose them to third parties.

VOUCHER CARDS

6. Goodwill makes available Voucher Cards to charities and other good causes (the “Causes”). The Voucher Cards have a unique Services access code, from where you can access Vouchers that have been made available by Businesses.  

7. Voucher Cards cost £20 each and at least £14 [70%] is retained by the Causes and constitutes a charitable donation from you to the Cause.

RIGHT TO CANCEL

8. As a new Member you will be able to access the Services and view the Vouchers that have been made available by Businesses. If you are not happy with what you see, or you do not accept these terms and conditions, we will offer you a full refund of the £6 admin cost of the Voucher Card (provided you have not accessed any of the Vouchers). Any amount over £6 that you paid constitutes a charitable donation to the Cause and therefore will not be refunded.

RESPONSIBILITY

9. Our sole responsibility is the provision of the Services and we warrant that we will use our reasonable endeavours to making available the Services during normal business hours.

10. We reserve the right to withdraw or suspend the Services at any time. If we withdraw the Goodwill Services before you have redeemed a Voucher, we will offer you a full refund of the £6 admin cost of the Voucher Card. Any amount over £6 that you paid constitutes a charitable donation to the Cause and therefore will not be refunded.

11. It is the Businesses, and not Goodwill, who enters in to a contract with you for the provision of the products and/or services described in the Voucher and they are wholly responsible for providing you with those products and/or services. This means that:t:

a. We have no responsibility for the provision described in a Voucher;

b. We make no warranties or representations about the quality, usability, safety, fitness for purpose, or availability of any such products and/or services; and

c. We accept no liability for the provision of, or the failure to provide, such products and/or services, or for any loss you may suffer in connection with your use, or attempted use or any products and/or services provided by Merchants.

12. Without prejudice to anything else in these terms and conditions, our maximum liability to you for any liability arising in connection with your use of the Goodwill Services shall be £6.

13. Nothing in these terms and conditions shall exclude or limit our any liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation and any other liability that we cannot lawfully exclude.

RESTRICTIONS

14. You must use Vouchers only for your personal use and must not reproduce, sell or trade a Voucher or disclose any Voucher codes or access codes contained on a Voucher.

15. Use of a Voucher is subject to any additional terms and conditions set out on the Voucher.  

16. In order to use the Services, you will need to create an account with personal information including your name and a valid email address. We may also collect other information about your access to and use of the Services and Goodwill is free to use such information for its own commercial benefit and that of Causes under the terms of the Privacy Policy.  

GENERAL TERMS

17. These terms and conditions, along with the Privacy Policy contain all the terms agreed between the parties regarding their subject matter.   This means that you agree that nothing we have said to you forms part of the legally binding contract between us unless it is contained in these terms and conditions.    

18. Third party rights: All provisions of these terms and conditions apply equally to and are for the benefit of Goodwill and its Affiliates, officers and directors. Subject to the previous sentence, no term of these terms and conditions is otherwise enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it

19. Severability: If any provision of these Terms of Sale is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and where capable the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

20. Governing law: These terms and conditions are governed by and construed in accordance with the laws of England and Wales.

21. These Terms of Use were most recently updated on 1st August 2024. We reserve the right to amend these Terms at any time and amendments to these Terms of Use will be posted on the Goodwill website.
